What is the Effect of This Agreement
1 This Agreement applies to the publication by ozgunsales.com /or its related bodies corporate (ozgunsales) of the advertisement submitted by you, the person named and described in the online application (You).
2 Placing an Advertisement
In order to place an advertisement (Ad) for an item (Item) You must:
1. be 18 years or over;
2. if you are selling a firearm as a private person, you must posses current valid Australian “Shooters license”. Any transfers of firearms must be conducted through a registered dealer, in accordance with the laws in that State.

3. complete and submit the online application form (Application); and
4. pay the prescribed advertising fee.
3. What You Must Do
You must :
1. provide all information for Your Ad ( including any photographs ) in the form required by ozgunsales from time to time;
2. describe the advertised Item accurately;
3. comply with any relevant ozgunsales advertising policy;
4. obtain permission from the owner of copyright in any third party material used in Your Ad;
5. maintain the confidentiality of all Your user ID and password information required to access Your Ad and immediately change the password if it is lost, stolen or compromised in any way. You are responsible for all transactions entered into under Your user ID and password; and
6. remove Your Ad if the advertised Item is:
1. sold; or
2. withdrawn by You from sale.
4. What You Must Not Do
1. You must not offer for sale any Item:
1. not located in Australia unless you specify its Location Overseas clearly in the Advertisement and specify the price in Australian currency;
2. if a firearm, that You are not the owner of; or
3. in all other cases, which You do not have the right to sell.
2. You must not submit an Ad which:
1. does not comply with all relevant laws;
2. infringes the intellectual property rights of any person including any company or organisation;
3. is illegal, fraudulent, obscene, offensive, defamatory, or in any way unsuitable for people under the age of eighteen (18) years;
4. is misleading or deceptive or likely to mislead or deceive including, photos or text that do not match the Item;
5. comprise anything which may adversely reflect on ozgunsales or any website on which Your Ad is published; or
6. include references or links to other websites or HTML enhancement text;
7. offers multiple Items in a single Ad;
3. You must not alter or amend an Ad to describe or offer an Item which is different to the Item originally published.
5. Publication of Advertisements
1. ozgunsales is not bound to publish Your Ad until accepted by ozgunsales. Your Ad is accepted when ozgunsales publishes Your Ad.
2. If accepted, ozgunsales will publish Your Ad as set out in the Application on the terms and conditions of this Agreement.
3. ozgunsales may republish Your Ad on such other websites, search engines, applications and print or other media as ozgunsales determines from time to time in its absolute discretion.
4. You acknowledge and agree that while every endeavor will be made to publish Your Ad as submitted, ozgunsales will not ( other than as set out in clause 10) be liable for any error, omission or failure to publish Your Ad in the form ordered, including acts or omissions of ozgunsales, its employees or agents.
5. ozgunsales may refuse to publish, withdraw or terminate the publication Your Ad if:
1. ozgunsales determines, in its absolute opinion without notice, You are not a firearms licence holder or otherwise not entitled to place an Ad;
2. You breach this Agreement; or
3. You have not logged on to the administration pages of Your Ad for more than 90 days; or
4. ozgunsales determines, in its absolute discretion without notice, to refuse to publish, withdraws or terminate the publication Your Ad.
6. Despite anything in this Agreement, ozgunsales has absolute editorial control in relation to the publication of Your Ad, including, but not limited to the format, position and placement of Your Ad.
7. Third party offers to republish Your Ad in print or other media are subject to separate terms and conditions. ozgunsales will not be responsible for third party terms and conditions, any services provided by the third party or resolving any dispute between You and any third party.
6. Cancellation and Withdrawal of Advertisements
1. Once Your Application is submitted to ozgunsales it cannot be cancelled.
2. An Ad may be removed at any time after publication. All advertising fees remain payable and if paid, You will not be entitled to a refund.
3. It is expected that your ad have at least 1 clear photo of your firearm and it suits our guidelines (image guidelines can be viewed at the bottom of this page)
7. Intellectual Property Rights
You hereby assign to ozgunsales all copyright and other intellectual property rights in Your Ad (other than third party material).
We will watermark images provided
8. Payment
1. You must pay the advertising fee at the rate and in the manner set out in the Application.
2. The advertising fee is payable despite the termination of this Agreement or failure to publish an Ad which is caused by You.
3. You will not be entitled to a refund or credit if ozgunsales withdraws or terminates the publication of Your Ad if You were not entitled to place an Ad or You are otherwise in breach of this Agreement.
9. You Indemnify ozgunsales
You indemnify ozgunsales against all actions, claims and demands (including the cost of defending or settling any actions, claims and demands) which may be instituted against ozgunsales arising out of:
1. a breach of this Agreement by You;
2. any willful, unlawful or negligent act or omission by You;
3. the publication by ozgunsales or any other person of Your Ad;
4. the sale or offering for sale of any Item.
10. ozgunsales Liability to You is Limited
1. ozgunsales will only be liable to You:
1. where the law implies a term into these terms and conditions which cannot be excluded and ozgunsales breaches that term. Provided that, where the breach relates to goods or services that are not of a kind ordinarily acquired for personal, domestic or household use or consumption and where it is fair and reasonable to do so ozgunsales liability is limited, at its option, to replacing, repairing or re-supplying the relevant goods or re-supplying the relevant services; or
2. if the claim arises from or in connection with any deliberate breach of these terms and conditions or fraud by ozgunsales.
2. Other than as set out above, ozgunsales will not be liable to You:
1. for claims arising out of or in connection with this Agreement or the publication of Your Ad whether arising in contract, tort (including negligence), indemnity, strict liability, breach of warranty or statute; and
2. for loss of use, production, profit, revenue, business, data, contract or anticipated savings or for delay or for any financing costs or increase in operating costs or any economic loss for any indirect or consequential loss or damage.
3. For the purposes of clauses 9 and 10, the term ozgunsales will mean ozgunsales, its officers, employees, contractors and agents, whether individually or collectively.
11. Privacy
Please be aware that as an advertiser on the ozgunsales network You may receive correspondence regarding the status of Your Ad. This may include confirmation of the receipt and publication of Your Ad, confirmation of any changes made by You, and notification of possible changes to the status of Your Ad. You will also be notified of any changes to ozgunsales or associated websites that may have a direct effect on the content or appearance of Your Ad. This correspondence forms part of this service and is necessary for the management of Your Ad. If You do not wish to receive this correspondence please do not submit an advertisement for publication on ozgunsales network.
12. What Law Governs this Agreement
This Agreement is governed by and construed in accordance with the laws of the State of Victoria Australia and You irrevocably submit to the exclusive jurisdiction of the courts in that State.
13. Entire Agreement
This Agreement, the Application, ozgunsales Terms and Conditions of Use and any warranties implied by law which cannot be excluded form the entire Agreement between You and ozgunsales . All other terms whether express or implied are excluded. This Agreement will prevail to the extent of any inconsistency with the Terms and Conditions of Use.
14. ozgunsales May Change This Agreement
1. ozgunsales may, in its absolute discretion modify or amend this Agreement and such modifications or amendments will be binding upon You once displayed on this web site. You should regularly check theses terms and conditions displayed on this web site.
2. All rights not expressly granted are reserved.
3. If any provision of this Agreement is invalid, illegal or unenforceable in any respect such invalid, illegal or unenforceable provision is to be severed from this Agreement and the remaining terms will apply.

Ozgunsales takes reasonable steps to protect personal information collected from misuse, loss, unauthorised access, modifications or disclosure
You do not need to register to view ads on Ozgunsales or contact sellers. You will need to register in order to sell items and the information you provide such as name, email address, phone number and state will be made available on the internet for buyers to contact you. We do not require you have a phone number but you will need to provide a means for contact, such as an email address.
Image Guidelines
The photos uploaded must be your own and clear of the firearm you wish to advertise. It must not contain other items for sale unless it is part of the bundle and you are selling them all together.
The first image must be cropped to suit our photo guidelines for listing view so that it will produce a thumbnail size of 500w x 150h. If your image at any time does not suit our guidelines you will be informed and expected to change the image. We will delete the photo if it does not meet our guidelines. If there is continued breaches of the image guidelines a charge for each advert may be charged to you or your advert deleted.
